El sistema de justicia que condenó a los Cinco: La ley contra el inocente

La injusticia cometida contra los Cinco resulta patente para todo el que lea las actas del juicio o los artículos de Ricardo Alarcón recogidos bajo el título “Los héroes prohibidos” (1). “Gerardo [uno de los Cinco] –señala Alarcón- es quizás la única persona condenada a morir en prisión por un ‘crimen’ que no existió, con el que no tuvo relación alguna y del cual el acusador reconoció carecer de evidencias”. La sobresaturación del sistema judicial estadounidense es una de las causas de su colapso. Con 2, 300, 000 presos, la cifra más alta del mundo, que se eleva a cerca de 7 millones si se cuentan los ex-convictos y los que permanecen libres pero sujetos a ciertos tipos de libertad condicionada, el sistema está a punto de estallar; síntoma alarmante es el anuncio de la gobernación de California de que próximamente se verá obligada a poner en libertad a miles de presos porque carece de recursos para sustentarlos. La mayoría de los casos que competen a los tribunales (más del 90 %) tienen que resolverse mediante negociaciones entre el fiscal y el acusado o su representante, porque no existe capacidad en el sistema para el número de juicios que, de otro modo, tendrían que celebrarse. Inherente a este procedimiento es el hecho de que, con frecuencia, un inocente se ve forzado a declararse culpable de un cargo menor para evitar ser condenado por otro de mayor gravedad; y con frecuencia también, un culpable recibe una condena menor de la que merece o queda libre a cambio de admitir su culpabilidad o acceder a testificar contra sus cómplices. Este procedimiento, que forma ya parte estructural de la maquinaria jurídica norteamericana, es un verdadero cáncer del sistema, una fábrica que convierte masivamente a inocentes en culpables y a muchos culpables los exonera por cooperar con la fiscalía. La corrupción alcanza a los más altos niveles. En estos días, por ejemplo, crece en todo el país un movimiento que pide la renuncia de un miembro de la Corte Suprema de Justicia, el magistrado Clarence Thomas. El 19 de junio el New York Times denunció los nexos existentes entre el juez y Harlan Crow, influyente activista texano de ultraderecha (2). Crow es uno de los mayores contribuyentes de la derecha recalcitrante. Se ha revelado que donó $500,000 a Ginni Thomas, esposa del honorable juez, para actividades políticas relacionadas con el “Tea Party”.
